TERMS OF SERVICE

Welcome to the Jamie Anne Aesthetics website! Before using our online store and making a purchase, please read these Terms of Service (the “Agreement”) carefully. 

I.  ONLINE STORE AND PURCHASING TERMS 

1. STORE HOST, ACCOUNT: Our Store is hosted on Shopify, Inc. They provide us with an online e-commerce platform that allows us to sell our Products and Services to You, defined below. In the event of technical issues with your account, Jamie Anne Aesthetics refers You to Shopify support. Jamie Anne Aesthetics does not have access to your account details. If you would like more information regarding Shopify’s Privacy Policies and Terms of Use, and how they collect and store information, we encourage You to visit their respective websites.

2. PRODUCTS, SERVICES: Certain products or Services may be available exclusively online through the Site. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy, below. 

We do our best to ensure the Products and Services listed are thorough, accurate, and helpful to our customers. Nonetheless, there may be times when certain information may be incorrect, incomplete, or appear inaccurate because of the browser, hardware, or other technology that you use. For example, We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right to correct errors (whether by changing information on the Services or by informing you of the error and giving you an opportunity to cancel your order) or to update product information at any time without notice. Subject to applicable law, all product descriptions are subject to change at any time without notice, in our sole discretion. Any offer for any product made via our Services is void where prohibited

We reserve the right to change the prices and available products at any time. Quantities of some products may be limited and stock cannot always be guaranteed. We reserve the right to discontinue any product or Service at any time. Products and/or Services offered for sale on this Site are for sale only in the jurisdictions set forth in the Returns and Shipping Policies and all prices are quoted in US Dollars. The prices displayed do not include shipping and handling charges or applicable taxes, which charges and taxes will be communicated to You at check out before you place an order and you are responsible for paying such charges and taxes to Jamie Anne Aesthetics, subject to applicable law.

We have the right to refuse or limit any orders or quantities, extend the delivery timeline for any reason after the order has been placed and accepted, and/or refuse to ship a product to You for any reason, subject to applicable law. We are not liable if a product is unavailable or if shipment is delayed.

3. PURCHASES, PAYMENTS: We reserve the right to refuse purchase to anyone for any reason at any time. By making a purchase, You expressly agree that Jamie Anne Aesthetics is authorized to charge your selected purchase on the payment method You designate, including any recurring fees on a recurring basis. All fees and applicable taxes are payable in US Dollars. Stated prices do not include any duties, sales, use, value-added, excise, federal, state, or other local taxes. We have the right to charge You any taxes that we believe we are legally required to pay or collect related to your purchase.  Receipts are sent once the charge is successful to the registered email account. You can update and change payment information at any time in your Account. You represent and warrant that You have the legal right to use the payment method, and that if the billing account is owned by another individual, that you have their  permission. 

3.1 ORDER CANCELLATION: Except as expressly provided in these Terms, all orders are non- cancelable; We may grant or deny cancellation requests for individual orders in our sole and absolute discretion, subject to applicable law. We may also, in our sole discretion, cancel your payment at any time by providing notice to You, or prevent you from initiating future payments for any reason, including without limitation: (i) if You attempt to use the Services in breach of any applicable law, regulation, or policy including the card network rules or regulations; (ii) if You use the Services in breach of these Terms; (iii) if your payment method is declined; (iv) if We suspect fraudulent, unlawful or improper activity regarding a payment; (v) if We detect, in our sole discretion, that your payments have excessive disputes, high reversal rates, or present a relatively high risk of loss; (vi) your failure to cooperate in an investigation or provide additional information when requested; or (vii) any other circumstances we deem appropriate in our sole discretion.

3.2 PAYMENT PROCESSOR: Payments are processed utilizing Shop’s integration with ShopPay.  For information on how ShopPay process transactions, we encourage You to view their billing and privacy policies. 

3.3 PROMOTIONAL CODES: Jamie Anne Aesthetics may, from time to time in its sole discretion, offer certain promotional codes for discounts. Promotional codes are non-transferable and are not redeemable for cash, credit, or towards previous purchases, and cannot be used in conjunction with any other promotion, unless otherwise stated. The promotional code must be redeemed at the time of checkout, unless otherwise advertised, and cannot retroactively be applied to a purchase. There is no cash alternative. Limit one promotional code per customer. Promotional codes are void where prohibited. Any promotional program may be terminated or modified by Jamie Anne Aesthetics at any time in its sole discretion, subject to applicable law.

4. RETURN POLICY: Jamie Anne Aesthetics has a 14-day return policy; from the day You receive the item, per delivery providers confirmation, You have fourteen (14) days to request a return. We refund based on the product value at checkout, and do not refund any shipping costs from your order. 

To be eligible for a return, the item must be in the same condition that You received it, unopened, unused, and in its original packaging. You will need to provide the order number, receipt, or proof of purchase.

4.1 DAMAGES AND ISSUES: Please inspect your order upon reception and contact us immediately (no later than 7-days from delivery) if the item is defective, damaged, if you receive the wrong item, or if You are missing an item so that We can evaluate the issue and make it right.

5. SHIPPING POLICIES: You will be notified by email when your order ships and provided with tracking information. Shipping times vary based on the method of delivery and shipping destination. Holiday volume and carrier issues may result in delays which Jamie Anne Aesthetics is not responsible for.

If You would like to make any modifications to your order, including to the shipping address, please contact us by email support@jamieanne.co as soon as possible after placing your order. Once your order has been processed/fulfilled we are unable to make any further adjustments or changes.

5.1 TRANSFER OF TITLE AND RISK OF LOSS/DAMAGE: Subject to applicable law, title to, and the risk of loss/damage of all products passes from us to You at the time we deliver the Products to our fulfillment partner for shipment. By purchasing products for shipment, We choose any and all procedures, packaging and the fulfillment partner for products. We may not be able to have your order shipped to certain addresses or on certain days. We reserve the right to ship your order in multiple boxes or shipments.

6. MEMBERSHIP 

6.1 MEMBERSHIPS, CANCELLATION: Jamie Anne Aesthetics offers various “Membership(s)” - renewing monthly or annual commitment. All Membership pricing is subject to increase upon 30-days written notice. 

Membership continues to renew until canceled by You, in your account. Failure to timely cancel will result in an auto-renewal. When You cancel prior to the next billing date, You still maintain access to the Membership through the end of your billing cycle. If You do not cancel prior to your billing date You will be automatically billed, with no refund, for the subsequent month and continue to have access until your next billing date, at which point your Membership will be considered cancelled and You will not be billed further.

6.2 AUTO DEBIT: By purchasing a Membership, You expressly agree that Jamie Anne Aesthetics is authorized to, on a recurring basis on the same of the day of each month or year of the Membership, automatically charge the debit or credit card account You specified in your Account, subject to communicated increases, for the auto-debit plan You enrolled in. You understand and acknowledge that (1) Jamie Anne Aesthetics will initiate transfers/charges pursuant to this authorization not to exceed the amount shown on the sales page. Jamie Anne Aesthetics may discontinue processing of recurring charges if it is unable to secure funds from your debit/card due to, but not limited to, insufficient or uncollected funds in the account or insufficient or inaccurate information provided; (2) it is your responsibility to keep a current card or payment method on file with accurate billing information. Jamie Anne Aesthetics cannot be held responsible for errors in processing due to expired or inaccurate information; and (3) Jamie Anne Aesthetics is not responsible for any bank overdraft fees that may occur. 

7. CONSULTATIONS: Services may include 1:1 “Consultations” which are pre-scheduled video calls between You and a Jamie Anne Aesthetics provider. The following terms apply: (a) Consultations must be cancelled at least 24-hours prior to the start of the call time. Cancellations and reschedules may be done online only via the scheduling link; (b) If the cancellation is made inside of the 24-hour window prior to Consultations, services are forfeited; (c) Consultations are non-refundable, but may be transferred to a different day/time if timely changed outside of the 24-hour window; (d) a portion of the Consultation fee is applied to product purchase; and (e) Consultations are a prerequisite for access to and purchasing certain products and/or Services.  

II.  WEBSITE TERMS AND CONDITIONS 

1. OVERVIEW: The Agreement is between You, the user, and Jamie Anne Aesthetics LLC (“Jamie Anne Aesthetics”,  “Our” or “We” interchangeably). These Terms are applicable to all users of Jamie Anne Aesthetics through its website and its related domains, sub-domains, and mobile and desktop applications (the “Sites”), in relation to You visiting our Sites and/or purchasing something for us in the “Store” (individually and collectively the “Services”). These Terms govern your use of the Jamie Anne Aesthetics Sites, Services, including all functionalities, features, and all content and software associated with the Services as provided by Jamie Anne Aesthetics.

 Jamie Anne Aesthetics reserves the right to change the terms, conditions, and notices under which the Sites are offered, including but not limited to the charges associated with the use of the Services.

   2. REGISTRATION INFORMATION: The Sites are not directed at children under eighteen years of age. By providing information about yourself to Jamie Anne Aesthetics You are representing that You are the majority of age in your state or province or residence, OR have a parent/guardian’s approval and supervision if You are 13-18 years old, and that You, or your parent/guardian, is of legal age to form a binding contract, and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction.

 You also agree to (1) provide true, accurate, current, and complete information about yourself as prompted by the purchasing form available on our Sites; and (2) maintain and promptly update your information to keep it true, accurate, current, and complete.

 If You provide any information that is untrue, inaccurate, not current, or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Jamie Anne Aesthetics reserves the right to suspend or terminate your account, refuse any and all current or future use of the Service, including blocking purchases (or any portion thereof) at any time.

 Notwithstanding the foregoing, You hereby agree to voluntarily accept and assume any and all such risks as well as any risks not mentioned herein that are in any way associated with Your Participation, including those described in the below Release of Liability, Agreement to Participate, and Assumption of Risk. You agree that by participating in a Service, You do so entirely at your own risk.

2.1 ACCOUNT: Upon first purchase of the Sites and Services, You will be prompted to create an “Account,” which will be password protected via a unique password which You create. Once created, your Account will provide You direct access to the Services and allow You to store and update billing and contact information. If You are an existing Shopify user, your information previously and voluntarily shared with Shopify may auto populate, such as name, email address, billing address, and payment information.  

2.2 ACCEPTANCE OF TERMS:  The Services are made available for a limited, personal, non-exclusive, non-commercial use only. The Sites are offered to You conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Sites and Services, as defined below, constitutes your agreement to and acceptance of all such terms, conditions, and notices.

 Jamie Anne Aesthetics has the right, at its sole discretion, to modify, add, or remove any terms or conditions without notice or liability to you. Any changes shall be effective immediately; You may see the most recent changes and version of this Agreement as noted by the date at the top. You agree to review these changes from time to time and agree that any subsequent use by you of the Sites and Services following the changes shall constitute your acceptance of such change.

3. DISCLAIMERS, RELEASE OF CLAIMS: THE INFORMATION (INCLUDING, WITHOUT LIMITATION, ADVICE AND RECOMMENDATIONS) ON THE PRODUCTS AND SERVICES IS INTENDED SOLELY FOR EDUCATIONAL AND ENTERTAINMENT PURPOSES. IT IS NOT MEDICAL OR HEALTHCARE ADVICE, OR TO BE USED FOR MEDICAL DIAGNOSIS OR TREATMENT, FOR ANY INDIVIDUAL PROBLEM. IT IS ALSO NOT INTENDED AS A SUBSTITUTE FOR PROFESSIONAL ADVICE AND SERVICES FROM A QUALIFIED HEALTHCARE PROVIDER FAMILIAR WITH YOUR UNIQUE FACTS. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER REGARDING ANY MEDICAL CONDITION AND BEFORE STARTING ANY NEW TREATMENT.

JAMIE ANNE AESTHETICS AND ITS AGENTS ASSUME NO RESPONSIBILITY FOR ANY CONSEQUENCE RELATING DIRECTLY OR INDIRECTLY TO ANY ACTION OR INACTION YOU TAKE BASED ON THE INFORMATION, SERVICES, OR OTHER MATERIAL ON THE WEBSITE. WHILE Jamie Anne Aesthetics STRIVES TO KEEP THE INFORMATION ON THE WEBSITE ACCURATE, COMPLETE, AND UP-TO-DATE, Jamie Anne Aesthetics CANNOT GUARANTEE, AND WILL NOT BE RESPONSIBLE FOR, ANY DAMAGE OR LOSS RELATED TO THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THE INFORMATION ON THE SERVICES.

3.1 WARRANTY OF DISCLAIMERS: EXCEPT FOR ANY EXPRESS PRODUCT WARRANTIES WE MAY MAKE TO YOU, THE PRODUCTS AND SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We make no warranty that the Products or Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any information or content on the Services or the Products.

3.2 NO PRODUCT LIABILITY: You understand that Jamie Anne Aesthetics does not manufacture the products, and instead utilizes third party manufacturers and suppliers. As Jamie Anne Aesthetics is not the manufacturer of the products, We are not liable for the independent operations of our contract manufacturers and/or suppliers, including damaged defective products, or the damages that may occur as a result of such damage or defect. In no event shall Jamie Anne Aesthetics be liable for any direct, indirect, punitive, incidental, special, consequential damages to property or life, whatsoever, arising out of or connected with the use or misuse of the products or Services.  

3.3 NO GUARANTEED OUTCOMES: You understand that the outcomes obtained from the products and Services can be subjective and vary greatly depending upon circumstances outside of Jamie Anne Aesthetics’s control. Purchase of any product and/or Services does not guarantee that You will take any specific action and does not offer any guarantee of success. As such, You understand that Jamie Anne Aesthetics makes no guarantee, representation or warranty of any nature or kind that the product and/or Service will be effective or will result in any particular outcome. You agree that You will not hold the responsible, in whole or in part, for any result that You do or do not achieve.

4. INDEMNITY: You agree that You fully and completely, on behalf of your heirs, next of kin, family members, estate, beneficiaries, and representatives: (1) will not institute or attempt to institute any legal action, arbitration, demand, or processing; AND (2) hold harmless, indemnify, defend, and release Jamie Anne Aesthetics, in their individual capacity and legal capacity, and each of its officers, directors, employees and agents from any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with (a) your purchase of, access to, or use of the products or Services, (b) your User Content, as defined below, or (c) your violation of these Terms.

5. LIMITATION OF LIABILITY: (a) TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER JAMIE ANNE AESTHETICS NOR ITS SERVICE PROVIDERS INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE PRODUCTS OR SERVICES WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOST REVENUES, LOST SAVINGS, LOST BUSINESS OPPORTUNITY, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE PRODUCTS OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT Jamie Anne Aesthetics OR ITS SERVICE PROVIDERS HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Jamie Anne Aesthetics’S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE PRODUCTS OR SERVICES EXCEED THE AMOUNTS YOU HAVE PAID OR ARE PAYABLE BY YOU TO JAMIE ANNE AESTHETICS FOR USE OF THE SERVICES AND PURCHASE OF PRODUCTS OR ONE HUNDRED DOLLARS ($100) OR THE PRICE THAT YOU HAVE PAID FOR PRODUCTS, WHICHEVER IS GREATER.

THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN JAMIE ANNE AESTHETICS AND YOU.

 6. THIRD PARTY RELATIONSHIPS: 

6.1 THIRD PARTY WEBSITES: The Sites may contain links to other websites (the “Linked Sites”). The Linked Sites may not be under the control of Jamie Anne Aesthetics, and if not, Jamie Anne Aesthetics is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Jamie Anne Aesthetics is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Jamie Anne Aesthetics of the site or any association with its operators.

6.2 THIRD PARTY MANUFACTURERS: Jamie Anne Aesthetics designs and markets a variety of products that are manufactured by independent third-party contract manufacturers. These manufacturers are carefully selected based on their commitment to quality and their ability to meet our specifications and standards. While we collaborate closely with these manufacturers to ensure that the products meet our high standards, these manufacturers are not owned or operated by Jamie Anne Aesthetics.

 7. USER CONTENT: Our Services may allow You to share content such as product reviews via text and images. Anything that You post or otherwise make available through the Services is referred to as “User Content”.  By making any User Content available through the Services You grant Jamie Anne Aesthetics a non-exclusive, transferable, worldwide, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works based upon, distribute, and publicly display your User Content in connection with operating and providing the Services, and for promoting and redistributing part or all of the Services (and derivative works thereof) in any form, format, media, or media channels now known or later developed or discovered, including all media now known or hereafter devised. Should such User Content contain the name, identity, or likeness of third parties, You represent and warrant that you have obtained any appropriate consents and licenses for your use of such features and that Jamie Anne Aesthetics and its sub-licensees are allowed to use them to the extent indicated in these Terms.

You represent and warrant that You have (and will have) all rights that are necessary to grant us the license rights in your User Content under these Terms. You represent and warrant that neither your User Content, nor your use and provision of your User Content to be made available through the Services, nor any use of your User Content by Jamie Anne Aesthetics on or through the Services will infringe, misappropriate or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

7.1 FEEDBACK, SUBMISSIONS: If, at our request, You send certain specific submissions (for example contest entries) or without a request from Us, You send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “Comments”), You agree that We may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (a) to maintain any comments in confidence; (b) to pay compensation for any comments; or (c) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that We determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by You or any third-party.

 8. INTELLECTUAL PROPERTY: The Services (including without limitation all programs, compiled binaries, interface layout, interface text, documentation, resources and graphics) are the sole and exclusive property of Jamie Anne Aesthetics and is protected by copyright, trademark, patent, and other intellectual property common and statutory laws of the United States and other countries. Jamie Anne Aesthetics retains all ownership and intellectual property rights to the products, Services, content, and materials provided to You through the Services and Sites, including all copyrights, trademarks, and patents, belonging to Jamie Anne Aesthetics and related entities and individuals. The Site content and materials are being provided to You for your individual use only and with a single-user license; this means that You are not allowed or authorized to share, copy, sell, post, distribute, reproduce, duplicate, trade, resell, exploit, or otherwise disseminate any portion of the Site or Site content, electronically or otherwise, for business or commercial use, or in any other way that earns You money, without our prior written permission.

8.1 COPYRIGHTED CONSENT: The Sites and corresponding Services contain copyrighted material owned by Jamie Anne Aesthetics and protected under United States copyright laws, including the Copyright Act of 1976. Any reproduction or unauthorized use shall constitute infringement. Duplicating, recording, modifying, republishing, uploading, posting, distributing, or otherwise sharing materials or information obtained through the Sites is considered stealing and Jamie Anne Aesthetics may prosecute such misconduct to the fullest extent permitted by law.

8.2 TRADEMARKS, NAMES, LOGOS: All trademarks, names, and logos used on the Sites or delivered via the Services are either owned by Jamie Anne Aesthetics or a use right has been granted to Jamie Anne Aesthetics. Your use of the Services and Sites does not allow you to infringe those rights or the rights of the third parties that may exist in material contained in the Sites. No license is expressly impliedly granted within or because of your use of the Sites or Services. Without the prior permission of Jamie Anne Aesthetics, except in the utilization of our widgets or mobile applications, you agree not to display or use in any manner, any of the trademarks, names, and logos featured on the Sites for which you do not have personal rights.

9. PROHIBITED USES: In addition to other prohibitions as set forth in theSE Terms, You are prohibited from using the Site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Site, Service or any related website for violating any of the prohibited uses.

10. TERMINATION AND ACCESS RESTRICTION: Jamie Anne Aesthetics reserves the right, in its sole discretion, to suspend or terminate your access to the Sites and the related Services or any portion thereof at any time, without notice. This includes access to an overall Service, like the Jamie Anne Aesthetics, or an individual part of the Service, like the Jamie Anne Aesthetics community boards.

 11. PRIVACY POLICY: Jamie Anne Aesthetics respects your privacy and permits you to control certain aspects of the treatment of your personal information as set forth in our Privacy Policy. The Privacy Policy is expressly incorporated into this Agreement by this reference

12. GOVERNING LAW, DISPUTE RESOLUTION: To the maximum extent permitted by law, this agreement is governed by the Laws of the State of California, United States, and you hereby consent to the exclusive jurisdiction and venue of courts in Los Angeles County, California, United States. In all disputes arising out of or relating to the use of the Sites. All claims and disputes arising under or relating to this Agreement are to be settled by arbitration in the State of California, County of Los Angeles, before one arbitrator. This arbitration shall proceed solely on an individual basis without the right for any Claims to be arbitrated on a class-action basis or in a purported representative capacity on behalf of others. Claims may not be joined or consolidated unless agreed to in writing by all parties. The arbitration shall be administered under the rules of the American Arbitration Association and shall include a written record of the arbitration hearing. The arbitrator is not empowered to award punitive or exemplary damages, except where permitted by statute, and the parties waive any right to recover any such damages. Judgment on the Award may be entered in the Los Angeles Country, California. 

Use of the Sites is unauthorized in any jurisdiction that does not give effect to all provisions of this Terms and Conditions of Use Agreement, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Jamie Anne Aesthetics as a result of this agreement or use of the Sites. Jamie Anne Aesthetics performance of this Agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Jamie Anne Aesthetics right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Sites or information provided to or gathered by Jamie Anne Aesthetics with respect to such use.

 If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between You and Jamie Anne Aesthetics with respect to the Sites and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Jamie Anne Aesthetics with respect to the Sites. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

13. EMAIL COMMUNICATIONS: You understand that You may, from time to time, receive email communications from Jamie Anne Aesthetics related to products, Services, the Site, the Jamie Anne Aesthetics brand, and your participation in all of the above. By entering into this Agreement, You give Jamie Anne Aesthetics permission to email You, at the email address on file, regarding the same.
